Training Providers: Background Information

NOVA is accepting applications for qualified schools and programs interested in being placed on the State of California’s Eligible Training Provider List.  Programs must be designed to provide occupational and/or skill upgrade training for WIA participants.  NOVA primarily serves the employers, employees and residents of the cities of Cupertino, Los Altos, Milpitas, Mountain View, Palo Alto, Santa Clara, and Sunnyvale.

Once approved and placed on the ETPL, training providers will remain on the list as long as they pass regular monitoring reviews (both desk review and site review) and maintain current accreditation approval. However, NOVA will require timely updates on location, name change, curriculum, fee, and staff changes as they occur throughout each year, along with appropriate documentation or required approval if necessary. Applications are accepted on an on-going basis throughout the year.

If NOVA approves a particular program, it will be referred to the State for review and, if approved, will be placed on the statewide ETPL and accessible to all Workforce Investment Areas.


Scope of Services

The applicant may propose programs only for the primary activities of occupational skills training, skill upgrading, and/or entrepreneurial training. Secondary activities, offered only in conjunction with primary activities, may include but not be limited to such activities as adult education and literacy, counseling/case management, tutoring, support services, and job placement assistance, which must be offered as part of the normal scope of services of the applicant.


Applicant Eligibility

Criteria for Initial Eligibility

Initial eligibility is based on the provider’s authority or authorization to operate. Providers must meet one of the following criteria in order to have their program(s) listed on the ETPL:

  1. Postsecondary institutions eligible under Title IV of the HEA and offering programs leading toward an associate degree, baccalaureate degree or certificate. Completed applications received for these programs shall be listed on the statewide ETPL.
  2. Programs that are registered under the National Apprenticeship Act (NAA), or provide on-the-job training in the construction industry in accordance with WIA Section 122(h), and are approved by the Bureau of Apprenticeship and Training (BAT), for those programs that operate in California under the jurisdiction of BAT, and have a certificate of approval from the California Apprenticeship Council. Completed applications received for these programs shall be listed on the statewide ETPL.

  5. Approval by the Chancellor’s Office of the California Community Colleges.

Approval, registration, or exemption of the program by the Bureau of Private Postsecondary Education (BPPE): http://www.bppe.ca.govFor training providers with documented BPPE approval expiring after 6/30/07, please contact NOVA’s ETPL Administrator.  All other training providers please refer to items 1–5 above.
  7. In addition to the above criteria, a program that has been substantially modified in goals and/or curriculum shall be considered a new program subject to an initial eligibility determination only if the regulatory body over the program has required that it be submitted to that body for approval as a new program.


Application Review

As part of the application review process, NOVA reserves the right to obtain any and all information associated with this process including but not limited to: reviewing the program curriculum; contacting any individuals, agencies or employers listed in an application; or contacting other sources who are knowledgeable of the applicant's performance, qualifications and/or financial solvency. NOVA reserves the right to request additional data or information in support of applications.

The submission of an ETPL application does not commit NOVA to pay any costs incurred in the preparation of an application to this request, to award an agreement, or to refer any participants for training. NOVA reserves the right to accept or reject any or all applications received as a result of this request, to negotiate with all qualified sources, or to cancel in part or in its entirety this application if it is in the best interest of NOVA to do so.


Site Visit Recommendation

During the ETPL application process, a NOVA Training Specialist will call to arrange for a site visit to the proposed vendor to inspect training facilities, tools and/or technology, safety of the environment, and instructional quality. The Specialist will prepare a recommendation to the Training Supervisor in writing.


Evaluation of Application and Referral to ETPL

All applications and site visit reports will be reviewed by NOVA staff for completeness and to determine if the requirements as specified within this package have been met. All applicants meeting the requirements shall be referred to the State of California to be reviewed for placement on the Eligible Training Provider List. The State will verify certain application information, and successful applicant programs will be placed on the statewide ETPL. Listings of programs on the ETPL are accessible statewide to local one-stop operators.


Controlling Legislation

Denial of Listing, De-Listing, and Appeals

NOVA or the State may deny eligibility for the ETPL to any provider if:

  1. the application is not complete;
  2. the applicant fails to meet the minimum criteria for initial listing;
  3. the applicant intentionally supplies inaccurate information; or
  4. the applicant has substantially violated any WIA requirements.

If a local board denies a provider’s application for listing on the ETPL, the local board must, within 30 days of receipt of the application, inform the provider in writing and include the reason(s) for the denial and complete information on the appeal process.

NOVA or the State may de-list a program if:
  1. The local boards or EDD must de-list a program at any point at which it is determined that the program no longer meets the minimum criteria for initial listing. For example, a program can be de-listed if its eligibility depended on accreditation, and the accreditation was lost; 
  2. it is determined that the provider intentionally supplied inaccurate information; or 
  3. the provider has substantially violated any WIA requirements.

NOVA or the State will inform an applicant, in writing, of any de-listing of a program, including reason(s) for de-listing and complete information on the appeals process.
